By using any service of Thai Notary Law and Service Co., Ltd. ("Company", company registration No. 0405565001923) — whether through our website, LINE, telephone, email, or in-person at our office — you agree to be bound by these Terms and Conditions in their entirety. 1. Definitions
- "Company" means Thai Notary Law and Service Co., Ltd., including its directors, lawyers, employees, and agents.
- "Customer" or "You" means any individual, juristic person, or organization using the Company's services.
- "Services" means Notary Public certification, translation, criminal background check, consular legalization, embassy legalization, and all other legal services provided by the Company.
- "Documents" means originals, copies, or electronic documents submitted by the Customer for the requested service.
- "Service Fee" means the agreed remuneration payable by the Customer for the services rendered.
2. Scope of Services
The Company provides comprehensive notary public services including:
- Notary Public certification (signature, copy, translation, affidavit, power of attorney)
- Document translation by certified translators (50+ languages including NAATI for Australia)
- Criminal background checks (CID Thailand and 100+ countries)
- Consular legalization (Ministry of Foreign Affairs of Thailand)
- Embassy legalization (195+ embassies worldwide)
- Apostille service for Hague Convention member countries
- Visa, work permit, marriage, and divorce documentation
2.1 Translations are executed based solely on the original document provided. Any alterations to the source text after the work has commenced or been approved will be treated as a new assignment and charged accordingly.
2.2 The Company's services are limited to document translation and certification only. The Company explicitly declines any request to provide testimony to police authorities or appear as a witness in court proceedings.
3. Pricing & Quotations
Prices displayed on the website are starting estimates only. Actual pricing depends on page count, language, document type, urgency, government/embassy fees, and project-specific conditions.
The binding price is the price stated in the official written Quotation issued by the Company, or the price confirmed by an authorized Admin via LINE/email. Quotations are valid for 30 days from issuance.
4. Payment and Refund Policy
- 4.1 Full payment is required for services valuing less than THB 100,000.
- 4.2 For services valuing THB 100,000 or more, a 50% deposit constitutes acceptance of the service.
- 4.3 Once payment is made, it is strictly non-refundable under any circumstances.
Accepted payment methods: cash, Thai bank transfer, PromptPay QR, credit/debit card, Payment Link, cheque (large amounts), Wise / PayPal (international).
5. Revision and Warranty
- 5.1 The Company warrants the accuracy of the translation for a period of 30 days from the date of delivery. Corrections regarding translation errors (e.g., spelling, terminology) are provided free of charge within this period, provided such corrections do not deviate from the original source text.
- 5.2 Requests for corrections made after the 30-day period, or modifications based on preference rather than accuracy, will satisfy the criteria for a new service charge.
6. Limitation of Liability
6.1 The Company's total liability for any claims arising out of the services provided is strictly limited to the value of the service fee paid by the Customer for the specific translation/notary work in question.
The Company is not liable for: (a) delays caused by government agencies; (b) regulatory changes without prior notice; (c) inaccurate information supplied by the Customer; (d) Force Majeure events; (e) rejection by destination authorities for reasons unrelated to document quality.
7. Customer Obligations
- Provide accurate, complete, and lawful information and documents
- Pay the agreed Service Fee on time
- Cooperate with the Company in providing required clarifications
- Not use the services for unlawful, fraudulent, or harmful purposes
8. Cancellation Policy
- Before work commences: Cancellation permitted, full refund less administrative cost.
- Work in progress: Refund pro-rated for work not yet performed; actual costs incurred deducted.
- Completed work: Non-refundable. See Section 4.3.
9. Intellectual Property
All content, text, articles, guides, images, logos, trademarks, designs, and media on www.ทนายโนตารี.com and www.thainotary.co.th are the intellectual property of Thai Notary Law and Service Co., Ltd., protected under the Thai Copyright Act B.E. 2537 (1994). Unauthorized copying, modification, reproduction, or distribution is prohibited and will be prosecuted under both civil and criminal law.
10. Confidentiality
The Company is bound by lawyer professional ethics under the Lawyers Act B.E. 2528 (1985), the Lawyers Council's Code of Conduct, and the Personal Data Protection Act B.E. 2562 (PDPA, 2019). Customer information and documents will not be disclosed to third parties without consent, except where required by court order or applicable law.
11. Force Majeure
The Company shall not be liable for delays or non-performance caused by events beyond reasonable control, including: natural disasters (floods, earthquakes, storms), epidemics (e.g., COVID-19), war, riots, terrorism, strikes, infrastructure failures, large-scale IT outages, government office closures, or government orders. In such cases, deadlines are extended for a period equivalent to the duration of the Force Majeure event.
12. Dispute Resolution
- Step 1 — Direct negotiation: The parties shall attempt good-faith negotiation within 30 days.
- Step 2 — Mediation: If unresolved, mediation by a mutually agreed third party.
- Step 3 — Litigation: Failing the above, disputes shall be submitted to the courts of competent jurisdiction in Bangkok, Thailand.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand, including the Lawyers Act B.E. 2528 (1985), the Lawyers Council Regulations on Notarial Services Attorneys, the Personal Data Protection Act B.E. 2562 (2019), and other applicable laws. Any interpretation shall be made in accordance with Thai law.
14. Amendments
The Company reserves the right to amend, modify, supplement, or terminate these Terms by posting at least 30 days' notice on the website. Material changes affecting Customer rights will additionally be notified via email and LINE. Continued use of the services after the effective date of any amendment constitutes acceptance of the revised Terms.
15. General Provisions
- Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
- No waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Entire agreement: These Terms constitute the entire agreement between the parties, superseding all prior agreements.
- Assignment: The Customer may not assign rights under these Terms to any third party without written consent.
- Language: In case of conflict between the Thai and English versions, the Thai version prevails.
